Update - VCAT Approval
The applicant lodged an appeal with the Victorian Civil and Administrative Tribunal (VCAT) against Council’s failure to grant a permit within the prescribed time for a multi-storey mixed use development at 251-261 Springvale Road, Glen Waverley.
A VCAT hearing was held on 11, 12, 13, 14, 18 and 20 April and 26 May 2023.
Amended plans were circulated as part of the developer’s appeal to VCAT and were the plans considered at the VCAT hearing.
The application documents that were submitted by the applicant are below.
Council confirmed its position and argued against the proposed development plan at the VCAT hearing.
The Tribunal concluded that the decision of Council should be set aside and found:
- The Proposal is acceptable in its physical and strategic context and will be viewed as part of a cluster of other high-rise buildings that will progressively emerge along Springvale Road;
- The Proposal is acceptable in terms of its built form, massing and scale and any variances from the dimensions specified in DDO12 will have no significant impact on its external presentation;
- The Proposal provides acceptable equitable development opportunities and will not prejudice the ongoing development of Area B of DDO12;
- Traffic impacts of the Proposal are acceptable having regard to the location of the Subject Land in a MAC and its proximity to alternative transport modes;
- The Proposal will provide acceptable amenity impacts subject to permit conditions; and
- The Proposal will provide acceptable wind impacts subject to permit conditions.

Update - February 2023
Amended plans have been circulated as part of the developer’s appeal to the Victorian Civil and Administrative Appeals Tribunal (VCAT) for the proposed mixed-use development at the site.
These plans will be considered at the VCAT hearing scheduled for 11, 12, 13, 14, 18 and 20 April 2023.
The key changes in the amended plans are as follows:
- Reduction in building height from 22 storeys to 21 storeys.
- Removal of built form (wings) to the site’s northern and southern boundaries from Level 3-10.
- Reduction in tower width from approximately 23.5m to 22.5m through increasing northern and southern setbacks of tower form from approximately 4.5m to 5-5.1m.
- Revised podium and building façade appearance including updated material palette and reduction in floor-to-floor heights for the retail/restaurant uses and upper-level accommodation.
- Revised upper floor plan (Level 20) to accommodate an integrated plant/services area, internal residential communal area and associated outdoor terrace area and two (2) dwellings.
- Reduction in number of dwellings from 147 to 138 and associated updates to internal apartment layouts.
- No change to the proposed car parking, with 167 spaces provided in 4 levels of basement

The matter has been listed for a six-day Merits Hearing at VCAT, commencing Tuesday 11 April 2023.
November 2022
The applicant has lodged a 'Failure to Determine' appeal with the Victorian Civil and Administrative Tribunal for the construction of a 21-storey mixed-use building on the land, including retail space and 147 residential apartments. Retail tenancies are located on the ground and first floors. A reduction in the standard car parking requirements is sought for both the residential and retail components, being a total of 30 car spaces. A total of 167 car spaces are proposed within the basement of the building, which are proposed to be accessed via the laneway to the rear of the site.
Council sought community feedback on the proposal and 154 objections were received.
As its meeting on 29 November 2022, Council determined it would not support the submitted the proposal and will oppose it at an upcoming hearing at VCAT that is listed for April 2023.

Background
Council sought community feedback on the proposed development of a 21-storey building for a mixed-use development comprising of six (6) retail tenancies/food and drink premises and 147 dwellings, at 251-261 Springvale Road, Glen Waverley.
The applicant, Hongxing Springvale Road Pty Ltd, originally proposed a $48 million development which included:
- Development of the land for a 21-storey building with four levels of basement
- Maximum height of 76.4m
- A total 147 dwellings
- Three levels of retail space comprising six tenancies with a total floor area of 1,832 square metres
- Four levels of basement car park providing a total of 167 car parking spaces including 152 spaces for dwellings and 15 spaces for retail premises, plus 86 bicycle spaces and seven motorcycle spaces.
