A Section 79 application for review under the Planning and Environment Act 1987 (the Act) has been lodged with the Victorian Civil and Administrative Tribunal (VCAT) against Council’s failure to grant a permit within the prescribed time.

The relevant VCAT reference number is P249/2025. Council’s reference number is TPA/55499.

Proposal

The application for review documentation identifies the proposal as ‘partial demolition of existing structures, extension of an existing building, a reduction in car parking, erection of signage and change of use from a dwelling to childcare’.

In summary the applicant seeks to:

Remove some of the on-site vegetation
Demolish the existing garage, concrete path, previous building extension, along with part of the existing roof to accommodate new structural loads.
Widen the existing crossover to Palmer Street.
Operate the proposed 2-storey childcare centre between Monday and Friday, 6.30am to 6.30pm, excluding public holidays, with a maximum capacity of 86 children.
Provide 18 car spaces
Make other changes including fencing along with signage.
