Update - VCAT Approval
The applicant lodged an appeal with VCAT on the basis of Council's failure to make a decision within a reasonable timeframe under Section 149 of the Planning and Environment Act 1987.
A VCAT hearing was held on 18 to 20 October 2022 regarding proposed development on the land at 15-17 Marriott Parade, Glen Waverley.
Amended plans were circulated as part of the developer’s appeal to VCAT, which included the following main changes:
- The childcare centre reduced in building height from five storeys to four storeys
- The number of children reduced from 204 to 172
- The number of staff for the childcare centre reduced from 29 to 36
- Car parking spaces reduced from 44 to 38
- Ground level facade materials changed from stacked stone to cream brick and render
- Staff facilities and services on level 3 of the childcare centre rearranged
- Structures at level 3 of the childcare centre reduced in size
- The pedestrian laneway separating the townhouses from the childcare centre increased from 3.385m to 4.5m at ground level; and from 2.245m to 3.5m at areas along the upper level (level 1)
- The townhouses moved further west as a result of the increased width of the pedestrian pathway, and western setback at ground level of the townhouses reduced from 5.365m to 4.5m
- The multi-purpose room/cinema component of the townhouses removed and replaced by gym
- Eastern and southern facades refined.
These plans were considered at the VCAT hearing.

Council confirmed its position and argued against the proposed development plan at the VCAT hearing.
Council is disappointed with VCAT’s decision to grant a planning permit for the proposed development.

As no question of law exists which would allow further appeal to a higher jurisdiction, this decision cannot be appealed.

About the Proposal
Council originally sought community feedback on the proposed development of a five-storey childcare centre and five townhouses over two levels of basement at 15-17 Marriott Parade, Glen Waverley.
Feedback was formally sought by 11 April 2022. However, Council continued to accept submissions on this proposal up until it made a decision.
Please note that this is a new development application independent of previous application TPA/51317.
The applicant, Human Habitats, proposed a $13.5 million development that included:
- Demolition of the existing buildings and construction of a five-storey building to be used as childcare centre and five townhouses.
- The childcare centre will accommodate a maximum of 204 children.
- Proposed operation hours are 6.30am to 7pm, Monday to Friday.
- The townhouses generally contain an open-plan living and dining area and a kitchen on the ground level and three bedrooms on the first level, and each townhouse is provided with a double garage within the basement
- A total of 44 car parking spaces is provided within the basement levels for the childcare centre.
- Separate pedestrian entrances are provided for the childcare centre and the townhouses.
- Proposed 1.65m-2.3m-high fencing along the Marriott Parade boundary in front of the childcare centre.
- Proposed business identification sign facing Marriott Parade for the childcare centre.
- Proposed vehicle access near the centre of the eastern property boundary via Marriott Parade.
- No statutory requirement for visitor car spaces for the townhouses as the subject land is located within the Principal Public Transport Network (PPTN).
