A 87A(2)(a) application to amend a Permit and Plans under the Planning and Environment Act 1987 (the Act), has been lodged directly with the Victorian Civil and Administrative Tribunal (VCAT). 

The relevant VCAT reference number is P202/2025. Council’s reference number in this matter is TPA/49621/B.

As the application is being considered by VCAT, should you wish to become party and take part in the VCAT proceeding you must complete a Statement of Grounds online at www.vcat.vic.gov.au/respondplanning and give a copy to the responsible authority (Monash City Council) and the applicant by 13 May 2025.

Background

Planning Permit TPA/49621 was issued following determination by VCAT on 11 December 2019.

The permit allows the construction of 5 dwellings on a lot in a 3-storey building. Common parking was provided to the rear including car stackers.

On April 2024, the applicant made application to VCAT pursuant to Section 87A (2)(a) of the Act to remove the car stackers and make changes to the design. The tribunal determined to approve the changes on 30 October 2024.

Amended plans

The applicant has now lodged a further amendment with VCAT under Section 87(2)(a) to amend the development to a 3-storey apartment building containing 9 dwellings (5 x 2-bedroom and 4 x 1-bedroom) with the provision of 4 car parking spaces.  The design of the buildings is changed.
