Amendment C163 – Corrections to the Monash Planning Scheme

Submissions sought by 28 June 2021

This amendment proposed a small number of corrections to the Monash Planning Scheme.

Amendment split into 2 parts - Part 1 now approved

The Department of Environment, Land, Water and Planning (DELWP) has split the amendment into two parts, approving Part 1 in February 2022 and approving Part 2 in May 2022 under delegation from the Minister for Planning. Changes proposed in Amendment C163 Parts 1 and 2 came into effect on 10 February 2022 and 26 May 2022 respectively and now appear in the Monash Planning Scheme.

Amendment C163 Part 1 (approved) includes the following properties:

  • 277 Huntingdale Road, Chadstone (a property on the edge of a local shopping strip)
  • 27 Regent Street, Mount Waverley (a residential property adjoining Valley Reserve)
  • 49 Westerfield Drive, Notting Hill (a property on the edge of a local shopping strip)
  • 12, 14-16 Dixon Street, Clayton (car park associated with the Monash Medical Centre)

Amendment C163 Part 2 includes the following properties:

  • 2 to 18 Miller Crescent, Mount Waverley (residential properties adjoining the railway corridor)

Adoption of amendment

Amendment C163 was adopted by Council at its meeting on 27 July 2021. For more information, please see Council Meeting Agenda - 27 July 2021(PDF, 217KB)

Following adoption, the amendment was then submitted to the Minister for Planning for approval.

The Amendment applies to a small number of properties and proposes to make the changes as outlined below.


2 to 18 Miller Crescent, Mount Waverley (residential properties adjoining the railway corridor):

Rezone the rear of these properties from  the Transport Zone (TRZ4) to the Neighbourhood Residential Zone – Schedule 3 (NRZ3) to reflect VicTrack’s disposal of the land to the adjoining landowners. The Vegetation Protection Overlay is also applied to land that is rezoned. 


277 Huntingdale Road, Chadstone (a property on the edge of a local shopping strip:

Rezone the existing shop from the General Residential Zone - Schedule 2 (GRZ2) to the Commercial 1 Zone (C1Z).


27 Regent Street, Mount Waverley (a residential property adjoining Valley Reserve):

Rezone land along the northern boundary of this site from the Public Park and Recreation Zone to the Neighbourhood Residential Zone - Schedule 2 (NRZ2) to reflect a successful historic adverse possession claim. The Vegetation Protection Overlay is also applied to land that is rezoned.


49 Westerfield Drive, Notting Hill (a property on the edge of a local shopping strip):

Rezone the existing shop from the General Residential Zone - Schedule 3 (GRZ3) to the Commercial 1 Zone (C1Z).


12, 14-16 Dixon Street, Clayton (car park associated with the Monash Medical Centre):

Rezone land from the Residential Growth Zone – Schedule 3 (RGZ3) to the Public Use Zone 3 (PUZ3) to reflect its ownership by the Monash Medical Centre and its use as a car park for the hospital.

Background

This amendment was on public exhibition until Monday 28 June, 2020. Any person who may have been affected by the amendment could make a submission. Submissions have now closed.

In accordance with the Planning and Environment Act 1987, all submissions must be available for inspection by the public, for 2 months after an amendment is implemented or lapses. Council must make a copy of every submission for any person to inspect free of charge. Council may be required to provide electronic copies of submissions on request (to the public) or publish them on our website. In this instance, we will make reasonable efforts to redact individuals’ identifying information such as their name, residential address, email address and telephone numbers.

Previously, at the Council meeting on 23 February 2021, Council resolved to seek authorisation to prepare and exhibit this amendment to the Monash Planning Scheme.
