Swimming Pool and Spa Registration

On 1 December 2019, the State Government introduced new laws to improve the safety around barriers and fencing. This requires all owners of existing permanent and/or relocatable swimming pools and spas to register their pool/spa with Council. More information: Permit requirements for swimming pools and spas

All permanent pools and spas, and most relocatable ones capable of holding water to a depth greater than 30cm must be registered. These include: inflatable pools, above-ground pools, indoor pools, hot tubs, bathing or wading pools.

relocatable swimming pool or spa must be registered if it is erected for 3 or more consecutive days.

Please note, even if the swimming pool or spa is deemed relocatable, it must have a compliant barrier at all times.

Registration process

Step 1.Step 1: Register

Registrations are for new swimming pools and spas or for existing swimming pool and spas that were never registered with Council.

It is a once off registration.

If you are unsure if your swimming pool or spa has been previously registered, please contact Council’s Building Department on (03) 9518 3555.

Registration of all permanent swimming pools or spas incurs a once-off fee of $35.10.  Your swimming pool or spa is added to Council’s register and remains there unless you decide to decommission your pool or spa.

A relocatable swimming pool or spa must be registered with Council if it is erected for 3 or more consecutive days. Relocatable swimming pools and spas also incur a fee of $35.10. This registration fee will need to be paid each time a relocatable swimming pool or spa is erected.

If you have any copies of Occupancy Permits/Certificates of Final Inspections or any other supportive documentation, please attach these to your application.

If the construction date of your swimming pool or spa cannot be verified, the current safety standard will be applied.

Step 2.STEP 2: Receive correspondence from Council

Receive correspondence from Council within 14 business days confirming:

  • your pool or spa has been registered
  • the date of construction and the applicable barrier standard
  • your right to appeal to the Building Appeals Board (BAB) in relation to council’s determination of the date of construction of the pool or spa
  • the date the first or next Certificate of Barrier Compliance must be lodged with Council

Step 3.STEP 3: Update certificate every 4 years

As part of the new regulations, you are required as a swimming pool/spa owner to obtain a Certificate of Barrier Compliance every 4 years and lodge it with Council (Swimming Pool and Spa Compliance Certificate).

It is your responsibility as an owner to ensure that your swimming pool/spa is maintained.

Council will write to you when the date is approaching to remind you to re-certify your swimming pool or spa barrier.
