Background

Council’s policy on footpath trading and access was last updated with the adoption of the Revised Footpath Trading and Access Policy in 2021.

This revision clarified that when public areas are made available for alfresco dining, food must be always offered for consumption during their use. In alignment with the Tobacco Act, smoking is prohibited in these areas as long as food is commercially available.

Complementing this policy, Parklets on Roads Policy 2023 permits hospitality businesses to utilise on-street car parking bays directly outside their premises, or a neighbouring business subject to their consent, and overall Council approval.

Although these policies were initially developed independently, they have now been consolidated into a single comprehensive policy document, the Footpath Trading and Access Policy 2024.
